RESERVE YOUR PUPPY

1. RESERVATION DEPOSIT

A reservation deposit is required to hold the Buyer’s position in a litter and/or reserve a specific puppy.

Once a deposit is accepted by Childress Creek Kennels, LLC, that reservation position or puppy will be held for the Buyer and removed from availability to other prospective buyers.

The reservation deposit will be applied toward the total purchase price of the Dog.

Because Childress Creek Kennels incurs substantial expenses associated with breeding, veterinary care, feeding, housing, raising, socializing, evaluating, and training its dogs:

2. FINAL PAYMENT & INSPECTION

The remaining purchase balance is due at pickup.

Before final payment, Buyer will have an opportunity to personally inspect the Dog and ask questions regarding the Dog.

Buyer is not required to make final payment until Buyer has inspected the Dog and is satisfied with the Dog at the time of pickup.

Once Buyer accepts the Dog and completes final payment:

The Two-Year Health Guarantee described below remains in effect following the sale.

3. REQUIRED VETERINARY EXAMINATION

Buyer agrees to have the Dog examined by a licensed veterinarian within 72 hours of taking possession.

Buyer is responsible for arranging and paying for this examination.

The purpose of this examination is to document the Dog’s condition shortly after transfer and identify any significant health concerns.

If the veterinarian identifies a significant health concern that Buyer believes may qualify under this Agreement, Buyer must promptly provide Childress Creek Kennels with the veterinarian’s written findings and supporting medical records.

4. TWO-YEAR GENETIC HEALTH GUARANTEE

Childress Creek Kennels provides a two-year limited genetic health guarantee beginning on the date Buyer takes possession of the Dog.

This guarantee applies to serious congenital or hereditary disorders that are medically determined to be genetic in origin and that render the Dog unable to perform the type of work for which the Dog was bred or sold.

A diagnosis by itself does not automatically qualify a Dog for replacement.

The condition must:

• Be diagnosed by a licensed veterinarian;
• Be supported by appropriate veterinary records, diagnostic testing, imaging, or other medical evidence;
• Be determined to be genetic or hereditary in origin;
• Be sufficiently severe to render the Dog unable to work as intended.

Childress Creek Kennels must be provided with all relevant veterinary records, diagnostic results, radiographs, imaging, and other documentation relating to the claim.

A veterinarian selected by Childress Creek Kennels must also review the medical evidence and agree that the condition is genetic or hereditary and meets the requirements of this guarantee.

5. HIP DYSPLASIA & GENETIC DISORDERS

Hip dysplasia may qualify under the Two-Year Genetic Health Guarantee when veterinary evidence establishes that the condition is genetic or hereditary and is sufficiently severe to render the Dog unable to work as intended.

The same standard applies to other congenital or hereditary disorders claimed under this guarantee.

The genetic health guarantee does not cover conditions caused by injury, accident, trauma, inappropriate exercise, excessive body weight, improper nutrition, environmental conditions, infectious disease, poisoning, neglect, abuse, or other non-genetic causes.

6. REMEDY UNDER THE HEALTH GUARANTEE

If a Dog qualifies under the Two-Year Genetic Health Guarantee, the Buyer’s remedy is a replacement puppy from Childress Creek Kennels .

A replacement puppy may not be immediately available. Childress Creek Kennels may provide the replacement from an appropriate future litter.

The timing and selection of the replacement puppy will depend upon puppy availability.

7. SURRENDER REQUIRED FOR HEALTH-GUARANTEE REPLACEMENT

If a Dog qualifies for replacement under the Two-Year Genetic Health Guarantee, ownership of the affected Dog must be surrendered to Childress Creek Kennels, LLC in order to receive the replacement puppy.

Once surrendered, Buyer relinquishes ownership and possession of the Dog to Childress Creek Kennels.

No refund will be issued for the Dog.

Childress Creek Kennels will not reimburse the former owner for the original purchase price, training expenses, veterinary expenses, medications, transportation expenses, food, supplies, boarding expenses, or other expenses associated with ownership of the Dog.

8. VOLUNTARY RETURN OR SURRENDER

If Buyer is unable or unwilling to continue owning the Dog, Buyer may contact Childress Creek Kennels regarding surrendering the Dog back to the kennel.

Acceptance of a voluntarily returned Dog is at the discretion of Childress Creek Kennels.

If Childress Creek Kennels accepts the Dog, Buyer understands and agrees that the Dog is being surrendered to Childress Creek Kennels, LLC.

Upon surrender, Buyer relinquishes ownership of the Dog.

9. KNPV DUTCH SHEPHERD REGISTRATION & BREEDING RIGHTS

KNPV Dutch Shepherds sold by Childress Creek Kennels are sold with their applicable registration documentation and full breeding rights, unless different terms are specifically stated in writing for an individual Dog.

Buyer assumes responsibility for maintaining the Dog’s health and making responsible breeding decisions following transfer.

10. LABRADOR REGISTRATION & BREEDING REQUIREMENTS

Labrador Retrievers sold by Childress Creek Kennels are sold with limited registration until Childress Creek Kennels’ breeding requirements have been completed and documented.

Before full breeding rights may be released, Buyer must provide documentation showing completion of:

• Official OFA Hip evaluation;
• Official OFA Elbow evaluation;
• Official OFA Patella evaluation;
• Embark DNA testing;
• Proof of appropriate vaccinations and preventative veterinary care through two years of age.

The Labrador may not knowingly be bred before these requirements have been completed and accepted by Childress Creek Kennels.

Upon satisfactory completion and documentation of these requirements, the Dog may become eligible for full breeding rights in accordance with the applicable registration requirements.

11. PICKUP

Buyer may pick up the Dog directly from Childress Creek Kennels at a mutually agreed date and time.

At pickup, Buyer will have an opportunity to inspect the Dog before completing final payment and taking possession.

Final payment is due only after Buyer has inspected the Dog and is satisfied with the Dog.

12. HAND DELIVERY

Childress Creek Kennels may arrange hand delivery of a puppy to the nearest appropriate major airport serving the Buyer within the contiguous 48 United States.

Airport delivery must be arranged with Childress Creek Kennels in advance.

Transportation and delivery charges are separate from the purchase price of the Dog unless specifically stated otherwise in writing.

The applicable delivery charge will be disclosed and agreed upon before transportation is scheduled.

13. BUYER RESPONSIBILITIES

After taking possession of the Dog, Buyer assumes responsibility for the Dog’s everyday care and management.

Buyer agrees to provide appropriate:

• Food and clean water;
• Housing and shelter;
• Exercise and physical conditioning;
• Training and socialization;
• Veterinary care;
• Vaccinations;
• Parasite and heartworm prevention;
• General care appropriate for the Dog’s age and intended work.

Buyer understands that working dogs require appropriate nutrition, physical conditioning, weight management, training, veterinary care, and responsible handling.

Buyer should maintain veterinary and medical records relevant to any potential claim under the Two-Year Genetic Health Guarantee.

14. VETERINARY & OWNERSHIP EXPENSES

Except for providing a replacement puppy under a valid Two-Year Genetic Health Guarantee claim, Childress Creek Kennels does not reimburse expenses incurred by Buyer after taking possession of the Dog.

This includes veterinary bills, diagnostic testing, surgery, medications, transportation, training, boarding, food, equipment, supplies, or other ownership expenses.

15. WORKING ABILITY & FUTURE PERFORMANCE

Childress Creek Kennels breeds, raises, evaluates, and trains dogs with the goal of producing capable working dogs.

Buyer understands that the future development of any dog is influenced by genetics as well as training, handling, environment, nutrition, conditioning, health, exposure, and experiences after leaving Childress Creek Kennels.

Unless specifically guaranteed in a separate written agreement for an individual Dog, Childress Creek Kennels does not guarantee that a puppy will obtain any particular hunting, field-trial, obedience, protection, working, breeding, temperament-testing, or competition title.

16. ENTIRE AGREEMENT

This Agreement represents the terms between Buyer and Childress Creek Kennels, LLC concerning the purchase, reservation, health guarantee, and return of the Dog.

Any modification to this Agreement must be agreed to in writing.

If one provision of this Agreement is determined to be unenforceable, the remaining provisions will continue independently.

17. GOVERNING LAW

This Agreement is governed by the laws of the State of Texas.

18. ELECTRONIC ACCEPTANCE

Buyer agrees that electronically accepting this Agreement and submitting the reservation constitutes Buyer’s electronic acceptance of this Puppy Purchase Agreement & Two-Year Health Guarantee.

Buyer acknowledges that Buyer has been provided an opportunity to read the complete Agreement before submitting the reservation deposit.
